...because I bought a Creative Zen Touch 40 GB for 1/4 the asking price it (Zune HD = $299). LAME 3.97 still sounds decent. Now I have 3 working mp3 players, two 20 GB, and one 40 GB and i don't use them all that much. The Zune HD is supposed to be better than the 3rd gen iPod Touch due to better battery life. Zen Touch would have the same battery life as the Zune HD.
